At Smarters App, we respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we provide a process for copyright holders to notify us of alleged infringements and for users to counter-notify if they believe their content has been wrongfully removed.

1. Copyright Infringement Notification

If you are a copyright owner or an authorized agent and believe that content hosted on Smarters App infringes your copyrighted work, you may submit a written notice to our designated Copyright Agent containing the following information:

  • A physical or electronic signature of the copyright owner or an authorized agent.
  • A description of the copyrighted work that you believe has been infringed.
  • A description of where the allegedly infringing content is located on Smarters App (e.g., a URL or other identifying information).
  • Your contact information, including your address, phone number, and email address.
  • A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on their behalf.

Once we receive a valid DMCA notice, we will promptly remove or disable access to the allegedly infringing content.

2. Counter-Notification

If you believe that your content has been removed or disabled by mistake or misidentification, you may file a counter-notification with our designated Copyright Agent. To be effective, a counter-notification must include the following:

  • A physical or electronic signature of the person filing the counter-notification.
  • A description of the content that was removed or disabled and the location where it appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of a mistake or misidentification.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the federal court in your district or, if you are outside the United States, in any judicial district where Smarters App may be found.
  • A statement that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.

Upon receipt of a valid counter-notification, we may reinstate the removed content unless the original copyright owner files an action seeking a court order to restrain the infringer.

4. Repeat Infringers

Smarters App reserves the right to terminate access for users who are repeat infringers of copyrighted content. We may suspend or terminate the accounts of users who repeatedly infringe the copyrights of others.

5. Limitation of Liability

Under the DMCA, Smarters App is not liable for infringing content if we act as a neutral service provider and promptly remove infringing content upon receiving a proper DMCA notice. We reserve the right to remove any content that we believe to be infringing, even without prior notice, and at our discretion.

6. Changes to This DMCA Policy

We may update this DMCA Policy from time to time. Any changes will be posted on this page with an updated effective date.
